Rights of residence safeguarded for UK citizens residing in Luxembourg

In the session that took place on Thursday 28th March 2019, Luxembourg Parliament (chambre des députés) has voted new provisions applicable upon Brexit which will guarantee the right of residence and work of UK citizens and their family members currently residing in Luxembourg.

In case the draft Withdrawal Agreement enters into effect, Luxembourg has opted that UK citizens must apply for residency documents within 3 months after the end of the transition period, i.e. after 31st December 2020. In accordance with the Withdrawal Agreement, UK citizens will remain EU citizens until the end of the transition period.

In case of "Hard Brexit“ former registration with the municipality will entitle UK citizens and their family members (who received a residence permit (carte de séjour) in case they are third country nationals) to stay in Luxembourg for a duration of one year starting on the date the United Kingdom of Great Britain and Northern Ireland have effectively left the EU.

They will be allowed to pursue any salaried or independent activities during such period and must apply for a residence permit at the latest three months before the end of the one year period.

To enter into effect, the now voted bill of law will have to be published in the Luxembourg legal gazette, which should be done shortly given the current political situation.
