Law approving the convention on cybercrime and its additional protocol on xenophobia and racism

The law approving the Convention on cybercrime signed in Budapest on 23 November 2001 and its additional protocol on xenophobia and racism signed in Strasbourg on 28 January 2003 was voted into law by the Luxembourg parliament on 4 June 2014 (the "Law"). The Law will be enacted and published in the Mémorial (the official gazette) within the next following weeks after which it will become effective.

Op 13 mei 2014 heeft het HJEU een belangrijke uitspraak gedaan inzake het privacyrecht en internetzoekmachines. Het HJEU oordeelde dat een internetzoekmachine zoals Google verantwoordelijk is voor de persoonsgegevens op webpagina’s van derden die Google vervolgens verwerkt heeft in zijn zoekmachine. De betrokkene mag verlangen dat de informatie over hem/haar niet meer door middel van opneming in de Google-resultaten ter beschikking wordt gesteld van het grote publiek. De grondrechten van de betrokkene krijgen in beginsel niet alleen voorrang op het economische belang van de exploitant van de zoekmachine, maar ook op het belang van het publiek om toegang tot deze informatie te krijgen.

A new right to claim data from bankrupt cloud computing providers

On 9 July 2013 a new law amending the Code of Commerce was enacted in Luxembourg (the “Law”). The Law introduces the right for a depositor to claim the recovery of intangible and non-fungible (i.e., identifiable and separable) goods from a bankrupt company. The parliamentary file aims clearly at including data from a bankrupt cloud computing service provider.

Working Party 29 guidance on cookie consent

Today the Article 29 Working Party ("WP29")[1] published a working document on how consent for cookies may be obtained. The WP29's opinions and working documents provide authoritative guidance on EU data protection rules.

Based on the e-Privacy Directive 2002/58/EC, the use of cookies or similar tracking technologies may require a website user's consent. The manner in which consent must be obtained varies per EU Member State. This WP29 document provides guidance on obtaining consent for a website operating across Member States.
