On 12 December 2013, the European Court of Justice (“ECJ”) delivered an interesting judgment on the amount of charges municipalities are allowed to levy when a data subject exercises its right to access its personal data that are processed in the municipal personal records database. This case concerns a dispute heard by the Court of Appeal of The Hague which submitted preliminary questions to the ECJ.

Favourable changes to the tax regime applicable to highly qualified and specialised international employees in Luxembourg

The Luxembourg Inland Revenue (Administration des Contributions Directes) changed the special tax regime for highly qualified international employees by way of amending the circular 95/2 on 27 January 2014. The objective of this regime, initially introduced on 31 December 2010, was to strengthen the competitiveness of Luxembourg companies by giving them the means to hire staff internationally and to encourage potential candidates to establish themselves in Luxembourg (“impatriates”).

On June 16, the Luxembourg tax authorities issued long-awaited published regulations (Circulaire du directeur des contributions L.G.-A nr 60 du 16 juin 2014) for the use of functional currency other than Euro for Luxembourg tax purposes by Luxembourg tax payers (the Regulations). The Regulations set forth the conditions to be met by a Luxembourg tax payer to be able to use functional currency as well as the exchange rates to be applied. In addition, the Regulations contain detailed examples explaining the practicalities of the use of a functional currency.

The Commission adopts new general block exemption regulation for state aid and new guidelines for state aid in the area of environmental protection and energy, the Draft ACM fining policy rules and draft leniency policy rules have been published, the General Court reduces Donau Chemie fine due to incorrect application of the Leniency Notice and  the Court of Justice rules that re-adoption of decision does not breach Bollor's rights of defense.

Op 12 december 2013 heeft het Europees Hof van Justitie drie arresten geveld m.b.t. de interpretatie van de voorwaarden voor de verkrijging van een aanvullend beschermingscertificaat zoals voorzien in artikel 3(a) en (c) van de Verordening nr. 469/2009 betreffende het aanvullende beschermingscertificaat voor geneesmiddelen. Het gaat namelijk om de Georgetown (C-484/12), Actavis v Sanofi (C-443/12) en Eli Lilly v HGS (C-493/12) – arresten.

General Court dismisses Faci's appeal in heat stabilizers cartel

On 20 March 2013, the General Court ("GC") handed down its judgment in Case T-46/10 Faci v Commission concerning an appeal in the heat stabilizers cartel. This judgment comes a little over one month after the three judgments that were handed down by the GC on 6 February 2014, relating to the same cartel. In its judgment, the GC dismissed Faci's appeal in its entirety.

The new Directive on Alternative Investment Fund Managers ("AIFM Directive") entered into force on 21 July 2011, following its publication in the "Official Journal" of the European Union on 1st. of July. However, as the AIFM Directive only sets out the high-level framework for future rules for the management of alternative investment funds in the European Union, implementing measures are needed to flesh out the specific legal, technical and regulatory details of the new regime.
