On April 27, 2017, the Chamber of Deputies passed a law allowing the sale of medicines not subject to prescription via the internet. This text can be considered as an advance, since it takes into account the recent evolutions of society. However, it is necessary to consider whether this law is in conformity with European Union law and in particular the provisions on freedom to provide services.
Uber's model is highly controversial: some hail competition from the services of taxi companies, others consider that the services offered by Uber constitute unfair competition for taxis and a circumvention of the law applicable in social matters.
The Grand-Duchy is one of the last European countries in which UBER does not offer its services. It will however probably not be the case for much longer. Representatives of the company already approached the Luxembourg Minister of Sustainable Development and Infrastructures. The latter indicated in a parliamentary response (2437) that the Luxembourg legislation may, under certain conditions, enable the offer of some UBER services.
On 2 July 2015, after two years of discussions, the Chamber of Deputies finally adopted the Law relating to electronic archiving and amending Article 1334 of the Civil Code, Article 16 of the Commercial Code and the amended Law of April 5, 1993 in relation to the financial sector (the “Law”).
Regulation (EC) 44/2001 of December 22nd 2000 on jurisdiction and the regulation and enforcement of judgments in civil and commercial matters (the "Brussels 1 Regulation") has been recast to further facilitate the free circulation of judgments and to further enhance access to justice. Regulation (EU) No 1215/2012 of December 12th 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (recast) (the "Recast Regulation") applies from January 10th 2015 (with the exception of Articles 75 and 76 thereof which apply since January 10th 2014).
Le 25 mai dernier a été déposé à la Chambre des Députés le projet de loi 6437 concernant la lutte contre le retard de paiement dans les transactions commerciales, portant transposition de la Directive 2011/7/UE du Parlement européen et du Conseil du 16 février 2011 concernant la lutte contre le retard de paiement dans les transactions commerciales1 et portant modification de la loi modifiée du 18 avril 2004 relative aux délais de paiement et aux intérêts de retard.
